Tožbeni razlogi in bistvene trditve

Odločba preizkuševalca: Registracija znamke Skupnosti se zavrne. Refused the application for a Community trade mark
Odločba odbora za pritožbe: Pritožba se zavrne. Dismissed the appeal
Navajani tožbeni razlogi: Kršitev Uredbe Sveta št. 207/2009 ker je odbor za pritožbe glede te zadeve napačno uporabil načelo prepovedi diskriminacije; alternativno, kršitev členov 7(1)(b) in 7(1)(c) Uredbe Sveta št. 207/2009 ker je odbor za pritožbe napačno sklenil da prijavljena znamka nima zadostnega razlikovalnega učinka. Infringement of Council Regulation No 207/2009, as the Board of Appeal misapplied the principle of non-discrimination to the facts of this case; in the alternative, infringement of Articles 7(1)(b) and 7(1)(c) of Council Regulation No 207/2009, as the Board of Appeal erred in its conclusion that the trade mark applied for does not possess sufficient inherent distinctiveness.
