Form of order sought

Declare that, by not having prepared, by 22 December 2009, river basin district management plans (both for river basin districts lying entirely within its territory and for international river basin districts) and by not having communicated to the Commission, by 22 March 2010, a copy of the draft river basin district management plans, the Kingdom of Belgium has failed to fulfil its obligations under Article 13(2), (3) and (6) and Article 15(1) of Directive 2000/60/EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy. (1) In addition, by having not commenced, by 22 December 2008 at the latest, the public information and consultation procedure concerning the draft river basin district management plans, the Kingdom of Belgium has failed to fulfil its obligations under Article 14(1)(c) of that directive, and

order the Kingdom of Belgium to pay the costs.

Pleas in law and main arguments

The time-limit for implementation of Directive 200/60/EC of the European Parliament and of the Council expired on 22 December 2003. At the date on which the present action was brought, the defendant had still not taken all the measures necessary to implement the directive or, in any event, had not informed the Commission thereof.
