REGOLAMENT TAL-KUMMISSJONI (UE) Nru 944/2013

tat-2 ta’ Ottubru 2013

li jemenda, għall-finijiet tal-adattament tiegħu għall-progress tekniku u xjentifiku, ir-Regolament (KE) Nru 1272/2008 tal-Parlament Ewropew u tal-Kunsill dwar il-klassifikazzjoni, l-ittikkettar u l-imballaġġ tas-sustanzi u t-taħlitiet

IL-KUMMISSJONI EWROPEA,

Wara li kkunsidra t-Trattat dwar il-Funzjonament tal-Unjoni Ewropea,

Wara li kkunsidrat ir-Regolament (KE) Nru 1272/2008 tal-Parlament Ewropew u tal-Kunsill tas-16 ta’ Diċembru 2008 dwar il-klassifikazzjoni, l-ittikkettar u l-imballaġġ tas-sustanzi u t-taħlitiet, li jemenda u jħassar id-Direttivi 67/548/KEE u 1999/45/KE, u li jemenda r-Regolament (KE) Nru 1907/2006 (1), u b’mod partikolari l-Artikolu 37(5) u l-Artikolu 53 tiegħu,

Billi:

Fir-rigward tad-dikjarazzjoni ta’ prekawzjoni P210 stipulata f’tabella 6.2 Part 1 tal-Anness IV tar-Regolament (KE) Nru 1272/2008 il-5 reviżjoni tas-Sistema Globalment Armonizzata tal-Klassifikazzjoni u l-Ittikettar ta’ Sustanzi Kimiċi (minn hawn ‘il quddiem GHS — Globally Harmonised System) tal-Ġnus Magħquda ġabet bidliet li ma kinux tqiesu fir-Regolament tal-Kummissjoni (UE) Nru 487/2013 (2). Għal raġunijiet ta’ konsistenza huwa neċessarju li jiġi stipulat allinjament sħiħ bejn il-GHS u r-Regolament (KE) Nru 1272/2008.

Il-Parti 3 tal-Anness VI għar-Regolament (KE) Nru 1272/2008 fiha żewġ listi ta’ klassifikazzjoni u ttikkettar armonizzati ta’ sustanzi perikolużi. It-Tabella 3.1 telenka l-klassifikazzjoni u l-ittikkettar armonizzati ta’ sustanzi perikolużi abbażi tal-kriterji stipulati fil-Partijiet 2 sa 5 tal-Anness I għar-Regolament (KE) Nru 1272/2008. It-Tabella 3.2 telenka l-klassifikazzjoni armonizzata u t-tikkettar ta’ sustanzi perikolużi abbażi tal-kriterji stipulati fl-Anness VI għad-Direttiva tal-Kunsill 67/548/KEE tas-27 ta’ Ġunju 1967 rigward l-approssimazzjoni tal-liġijiet, tar-regolamenti u tad-dispożizzjonijiet amministrattivi fir-rigward tal-klassifikazzjoni, l-imballaġġ u t-tikkettar ta’ sustanzi perikolużi (3). Dawk iż-żewġ listi jeħtieġ li jiġu emendati sabiex jinkludu klassifikazzjonijiet aġġornati għal sustanzi li huma diġà suġġetti għal dawk il-klassifikazzjonijiet armonizzati u biex jinkludu klassifikazzjonijiet armonizzati ġodda.

Il-Kumitat għall-Valutazzjoni tar-Riskji (RAC—Committee for Risk Assessment) tal-Aġenzija Ewropea għas-Sustanzi Kimiċi (ECHA – European Chemicals Agency) ħareġ opinjonijiet fuq proposti għal klassifikazzjoni u ttikkettar armonizzati ta’ sustanzi li kienu ġew ippreżentati lill-ECHA skont l-Artikolu 37 għar-Regolament (KE) Nru 1272/2008. Abbażi ta’ dawn l-opinjonijiet, kif ukoll tal-kummenti mibgħuta min-naħa tal-partijiet ikkonċernati, huwa f’loku li jiġi emendat l-Anness VI għar-Regolament (KE) Nru 1272/2008 sabiex jiġu armonizzati l-klassifikazzjoni u l-ittikkettar ta’ ċerti sustanzi.

Il-klassifikazzjonijiet armonizzati stipulati fil-Parti 3 tal-Anness VI għar-Regolament (KE) Nru 1272/2008, kif emendat b’dan ir-Regolament, ma għandhomx japplikaw immedjatament, għaliex ikun meħtieġ ċertu perjodu ta’ żmien sabiex jippermetti lill-operaturi jadattaw l-ittikkettar u l-imballaġġ tas-sustanzi u t-taħlitiet għall-klassifikazzjonijiet il-ġodda u biex ibigħu l-istokkijiet eżistenti. Barra minn hekk, ikun meħtieġ ċertu perjodu ta’ żmien biex jippermetti lill-operaturi jikkonformaw mal-obbligi ta’ reġistrazzjoni li jirriżultaw mill-klassifikazzjonijiet armonizzati l-ġodda għal sustanzi kklassifikati bħala karċinoġeniċi, mutaġeniċi jew tossiċi għar-riproduzzjoni, il-kategoriji 1 A u 1B (Tabella 3.1) u l-kategoriji 1 u 2 (Tabella 3.2), jew bħala tossiċi ħafna għall-organiżmi akkwatiċi li jistgħu jikkawżaw effetti fit-tul fl-ambjent akkwatiku, b’mod partikolari b’dawk stipulati fl-Artikolu 23 tar-Regolament (KE) Nru 1907/2006 tal-Parlament Ewropew u tal-Kunsill tat-18 ta’ Diċembru 2006 dwar ir-Reġistrazzjoni, il-Valutazzjoni, l-Awtorizzazzjoni u r-Restrizzjoni ta’ Sustanzi Kimiċi (REACH), li jistabbilixxi Aġenzija Ewropea għas-Sustanzi Kimiċi, li jemenda d-Direttiva 1999/45/KE u li jħassar ir-Regolament tal-Kunsill (KEE) Nru 793/93 u r-Regolament tal-Kummissjoni (KE) Nru 1488/94 kif ukoll id-Direttiva tal-Kunsill 76/769/KEE u d-Direttivi tal-Kummissjoni 91/155/KEE, 93/67/KEE, 93/105/KE u 2000/21/KE (4)

Fir-rigward tas-sustanza żift, qatran tal-faħam, temp.-għolja (Numru KE: 266-028-2), perjodu estiż ta’ żmien se jkun neċessarju biex jippermetti lill-operaturi biex jikkonformaw mal-obbligazzjonijiet li jirriżultaw mill-klassifikazzjoni armonizzata ġdida għal sustanzi klassifikati bħala tossiċi ħafna għall-organiżmi akwatiċi li jistgħu jikkawżaw effetti fit-tul fl-ambjent akwatiku, b’mod partikolari b’dawk stipulati fl-Artikolu 3 u l-Anness III tad-Direttiva 2008/68/KE tal-Parlament Ewropew u tal-Kunsill tal-24 ta’ Settembru 2008 fuq-it-trasport intern ta’ oġġetti perikolużi (5). Għaldaqstant, żmien itwal ta’ tranżizzjoni għandu jiġi maħsub qabel il-klassifikazzjoni armonizzata tkun trid tiġi applikata.

Fir-rigward tas-sustanza arsenur tal-gallju (Numru KE: 215-114-8), ir-RAC (il-Kumitat għall-Istima tar-Riskji) jinsab fil-proċess li jadotta opinjoni ġdida għall-klassi ta’ periklu “tossiċità għar-riproduzzjoni”. Għaldaqstant, din il-klassi ta’ periklu m’għandhiex tiġi inkluża fl-Anness VI tar-Regolament (KE) Nru 1272/2008 sakemm dik l-opinjoni ma tkunx iffinalizzata.

Fir-rigward tas-sustanza idroklorur tal-polieżametalen bigwanur (numru CAS 27083-27-8 jew 32289-58-0), dejta xjentifika ġdida ġiet magħmula disponibbli għall-klassi ta’ periklu “tossiċità akuta (inalazzjoni)”, li tissuġġerixxi li l-klassifikazzjoni ta’ din il-klassi ta’ periklu kif rakkomandat fl-opinjoni tar-RAC, li hi bbażata fuq dejta eqdem, tista’ ma tkunx adatta. Għaldaqstant, din il-klassi ta’ periklu m’għandhiex tkun inkluża fl-Anness VI tar-Regolament (KE) Nru 1272/2008 sakemm ir-RAC ma jkunx ingħata l-opportunità li jwassal opinjoni dwar l-informazzjoni l-ġdida, waqt li klassijiet ta’ periklu oħra koperti mill-opinjoni iktar bikrija tar-RAC għandhom jiġu inklużi.

Skont id-dispożizzjonijiet tranżizzjonali tar-Regolament (KE) Nru 1272/2008 li jippermettu l-applikazzjoni tad-dispożizzjonijiet il-ġodda fi stadju aktar bikri fuq bażi volontarja, il-fornituri għandom ikollhom il-possibilità li japplikaw il-klassifikazzjoni armonizzata stipulata fil-Parti 3 tal-Anness VI għar-Regolament (KE) Nru 1272/2008, kif emendat permezz ta’ dan ir-Regolament, u li għalhekk jadattaw l-ittikkettar u l-imballaġġ fuq bażi volontarja qabel id-dati sa meta il-klassifikazzjoni armonizzata se ssir obbligatorja.

Il-miżuri stabbiliti f’dan ir-Regolament huma skont l-opinjoni tal-Kumitat stabbilit bl-Artikolu 133 tar-Regolament (KE) Nru 1907/2006,

ADOTTAT DAN IR-REGOLAMENT:

Artikolu 1

Ir-Regolament (KE) Nru 1272/2008 huwa emendat kif ġej:

(1)

L-Anness IV huwa emendat skont l-Anness I ta’ dan ir-Regolament;

(2)

Il-parti 3 tal-Anness VI hija emendata kif ġej:

(a)

It-Tabella 3.1 hija emendata kif ġej:

(i)

L-entrati stipulati fl-Anness VI għar-Regolament (KE) Nru 1272/2008 li jikkorrispondu għall-entrati stipulati fl-Anness II għal dan ir-Regolament huma mibdulin bl-entrati stipulati fl-Anness II għal dan ir-Regolament;

(ii)

L-entrati stipulati fl-Anness III għal dan ir-Regolament huma mdaħħla skont l-ordni tal-entrati stipulati fit-Tabella 3.1.

(b)

It-Tabella 3.2 hija emendata kif ġej:

(i)

L-entrati stipulati fl-Anness VI għar-Regolament (KE) Nru 1272/2008 li jikkorrispondu għall-entrati stipulati fl-Anness IV għal dan ir-Regolament huma mibdulin bl-entrati stipulati fl-Anness IV għal dan ir-Regolament;

(ii)

L-entrati stipulati fl-Anness V għal dan ir-Regolament huma mdaħħla skont l-ordni tal-entrati stipulati fit-Tabella 3.2.

Artikolu 2

1.   Permezz ta’ deroga mit-tieni paragrafu tal-Artikolu 3(2), is-sustanzi u t-taħlitiet jistgħu, qabel l-1 ta’ Diċembru 2014 u l-1 ta’ Ġunju 2015 rispettivament, jiġu kklassifikati, ittikkettjati u ppakkjati skont ir-Regolament (KE) Nru 1272/2008 kif emendat b’dan ir-Regolament.

2.   B’deroga mit-tieni paragrafu tal-Artikolu 3(2), is-sustanzi kklassifikati, ittikkettjati u ppakkjati skont ir-Regolament (KE) Nru 1272/2008 u mqiegħda fis-suq qabel l-1 ta’ Diċembru 2014, ma għandhomx jintalbu li jerġgħu jiġu ttikkettjati u ppakkjati skont ir-Regolament (KE) Nru 1272/2008 kif emendat permezz ta’ dan ir-Regolament sal-1 ta’ Diċembru 2016.

3.   B’deroga mit-tieni paragrafu tal-Artikolu 3(2) it-taħlitiet kklassifikati, ittikkettjati u mmballaġġati skont id-Direttiva 1999/45/KE tal-Parlament Ewropew u tal-Kunsill (6) jew ir-Regolament (KE) Nru 1272/2008 u mqiegħda fis-suq qabel l-1 ta’ Ġunju 2015, ma għandhomx jintalbu li jerġgħu jiġu ttikkettjati u mmballaġġati skont ir-Regolament (KE) Nru 1272/2008 kif emendat permezz ta’ dan ir-Regolament sal-1 ta’ Ġunju 2017.

4.   Permezz tad-deroga mill-Artikolu 3(3) il-klassifikazzjoni armonizzata stipulata f’Parti 3 tal-Anness VI tar-Regolament (KE) Nru 1272/2008, kif emendat permezz ta’ dan ir-Regolament, jista’ jiġi applikat qabel id-dati msemmija fl-Artikolu 3(3).

Artikolu 3

1.   Dan ir-Regolament għandu jidħol fis-seħħ fl-għoxrin jum ta’ wara l-pubblikazzjoni tiegħu f’Il-Ġurnal Uffiċjali tal-Unjoni Ewropea.

2.   L-Artikolu 1(1) għandu japplika fir-rigward ta’ sustanzi mill-1 ta’ Diċembru 2014 u fir-rigward ta’ taħlitiet mill-1 ta’ Ġunju 2015.

3.   L-Artikolu 1(2) għandu japplika mill-1 ta’ Jannar 2015 għall-entrati kollha ħlief għall-entrata żift, qatran tal-faħam, temp.-għolja (Numru KE 266-028-2), li għalihom l-Artikolu 1 għandu japplika mill-1 ta’ April 2016.

Dan ir-Regolament għandu jorbot fl-intier tiegħu u japplika direttament fl-Istati Membri kollha.
