The European Parliament,
having regard to the Commission proposal to the European Parliament and the Council (COM(2009)0142),
having regard to Article 251(2) and Article 152 of the EC Treaty, pursuant to which the Commission submitted the proposal to Parliament (C7-0047/2009),
having regard to its resolution of 23 September 2008 with recommendations to the Commission on the alignment of legal acts to the new Comitology Decision (1),
having regard to Rule 55 of its Rules of Procedure,
having regard to the report of the Committee on Legal Affairs and the opinion of the Committee on the Environment, Public Health and Food Safety (A7-0036/2009),

Rejects the Commission proposal; |

2. |
Calls on the Commission to submit a new proposal taking into account the provisions of the Treaty of Lisbon, in particular Article 290 of the Treaty on the Functioning of the European Union, and Parliament's abovementioned resolution of 23 September 2008; |

3. |
Calls on the Commission to submit proposals aligning the acquis communautaire to Article 290 of the Treaty on the Functioning of the European Union; |
|
4. |
Instructs its President to forward its position to the Council and the Commission. |
