DECISION OF THE COLLEGE OF THE EUROPEAN PUBLIC PROSECUTOR'S OFFICE

of 7 February 2024

amending and supplementing the internal rules of procedure of the European Public Prosecutor’s Office

The College of the European Public Prosecutor’s Office (‘EPPO’),

Having regard to the Council Regulation (EU) 2017/1939 of 12 October 2017 implementing enhanced cooperation on the establishment of the European Public Prosecutor’s Office (‘the EPPO’) (1) (hereinafter referred to as ‘the EPPO Regulation’), and in particular Article 21 thereof,

Taking into account the proposal drawn up by the European Chief Prosecutor,

Whereas:

(1)

Almost three years following the start of operations and considering its unique structure, a new organisational chart of the EPPO has been adopted, establishing inter alia a College Secretariat.

(2)

Following the adoption of the organisational chart of the EPPO, it is necessary to proceed with adjustments to the Internal Rules of Procedure, in particular as regards the newly established College Secretariat.

(3)

There is a need to regulate in the Internal Rules of Procedure the possibility of establishing working groups and advisory groups to the College/European Chief Prosecutor.

(4)

The detailed procedure for the appointment of the European Delegated Prosecutors and the renewal of their 5-year mandate shall be provided for in the Decision of the College on the Conditions of employment of the European Delegated Prosecutors.

HAS ADOPTED THIS DECISION:

Article 1

Amendments

The Decision 003/2020 of the College of the European Public Prosecutor’s Office on the Internal Rules of Procedure of the European Public Prosecutor’s Office, as amended and supplemented by the Decisions 085/2021 and 026/2022 of the College of the EPPO, are amended and supplemented as follows:

(1)

Article 13 is amended as follows:

‘Article 13

The College Secretariat

1.   The College shall be assisted by a College Secretariat in the preparation of the College meetings, working in consultation with the European Chief Prosecutor.

2.   The College Secretariat shall, among other responsibilities, attend the meetings of the College, record and maintain minutes of the College meetings, compile summaries of meeting outcomes, and maintain comprehensive records of College activities.

3.   The Head of the College Secretariat, serving as Secretary to the College, shall be appointed by the College.’

(2)

after Article 14, a new article, 14a, will be added, with the following content:

‘Article 14a

Working groups

1.   The College and the European Chief Prosecutor may set up working groups and advisory boards to provide the College, or, respectively, the European Chief Prosecutor, with advice and expertise.

2.   The mandate, composition and practical functioning of the formations referred to in paragraph 1 shall be determined in the respective decision of the College or of the European Chief Prosecutor, establishing each working group or advisory group.’

(3)

in Article 24, the third paragraph is amended as follows:

‘3.   If no objection is lodged by a permanent member of the Permanent Chamber or by the supervising European Prosecutor, within a deadline determined by the Chair, the decision shall be deemed to have been adopted.’

(4)

Article 33 is amended as follows:

‘Article 33

Appointment of European Delegated Prosecutors and renewal of their 5-year mandate

The College shall decide on the appointment of the European Delegated Prosecutors and on the renewal of their 5-year mandate based on a proposal by the European Chief Prosecutor, in accordance with Article 17 of the EPPO Regulation and the rules provided for in the Decision of the College on the Conditions of employment of the European Delegated Prosecutors’.

Article 2

Entry into force

This decision shall enter into force on the day following that of its adoption.
