WHAT IS THE AIM OF THE DECISION AND THE REGULATION?

KEY POINTS

Sanctions

  • The DPRK has been subjected to a number of UNSCR, applying sanctions against the DPRK targeting its nuclear-related, other weapons of mass destruction-related and ballistic missile-related programmes; most recently UNSCR 2270 (2016).
  • In addition to applying UN sanctions, the EU has also put in place additional autonomous measures.

Trade on goods, services and technology

The decision and the regulation impose bans on trade, goods and technology which could aid the DPRK’s weapons programmes. These include:

  • export and import bans covering goods such as:
    • arms;
    • precious metals;
    • new helicopters and vessels;
    • aviation and rocket fuel;
    • luxury goods;
  • restrictions on financial support for trade;
  • investment restrictions including a ban on:
    • investment by the DPRK in EU countries;
    • participation or financing of any company involved in on the DPRK illegal activities or in the mining, refining or chemical sectors;
  • ban on financial assistance to DPRK except for humanitarian and developmental purposes addressing the need of the civilian population or the promotion of denuclearisation;
  • compulsory inspections on all cargo going to or coming from the DPRK via land, sea or air;
  • suspension of scientific and technical cooperation between EU countries and persons or groups officially sponsored by or representing the DPRK with exemptions for medical exchanges and other other activities deemed not to the DPRK’s weapons programmes;
  • admission and residence restrictions, but with humanitarian and certain other exemptions;
  • freezing of funds and economic resources.

Travel bans and asset freezing

The decision and the regulation impose travel bans and asset freezing on persons and companies linked to these illegal programmes;

  • lists of these persons and companies are annexed to the decision and regulation.
  • these annexes are updated as the UN adds or removes persons or companies from its lists.

FROM WHEN DO THE DECISION AND REGULATION APPLY?

The decision has applied since 29 May 2016. It repeals Decision 2013/183/CFSP.

The regulation has applied since 1 September 2017. It repeals Regulation (EC) No 329/2007.
