EXPLANATORY MEMORANDUM

1.           CONTEXT OF THE PROPOSAL

(1) The scope of the Common Fisheries Policy (CFP) extends to European Union autonomous trade measures for fishery and aquaculture products. Since the CFP is currently being reformed, the autonomous trade measures applicable to fishery products should be also revised to ensure further simplification, flexibility, transparency and coherence in line with the objectives of the CFP reform.[1]

(2) The EU supply of certain fishery products largely relies on imports. In the last 15 years the EU has become more dependent on imports to meet its consumption of fishery products: the EU self-sufficiency rate for fishery products has decreased from 57% to 38%. The main purpose of the autonomous trade measures for fishery and aquaculture products is to enable the EU fish processing industry to import third countries' raw materials under reduced or duty-free duties for further processing.

(3) The present Regulation will replace, merge and amend, as appropriate, three existing regimes for autonomous quotas and suspensions for fishery products, notably:

(4) Council Regulation (EC) No 1062/2009 of 26 October 2009 opening and providing for the management of autonomous Community tariff quotas for certain fishery products for the period 2010 to 2012 and repealing Regulation (EC) No 824/2007[2] to guarantee the appropriate supply conditions of certain fishery products for the EU industry.

(5) Article 28 and Annex VI of Council Regulation (EC) No 104/2000 of 17 December 1999 on the Common Organisation of Markets in fishery and aquaculture products[3] establishing a regime of suspensions of tariff duties for certain fishery products (7 products).

(6) Council Regulation (EU) No 1344/2011 of 19 December 2011suspending the autonomous Common Customs Tariff duties on certain agricultural, fishery and industrial products and repealing Regulation (EC) No 1255/96[4] containing a limited number of suspensions for fishery products (5 products).

(7) The existing suspensions will be transformed into quotas with volumes large enough to guarantee the predictability for EU processors.

2.           RESULTS OF CONSULTATIONS WITH THE INTERESTED PARTIES AND IMPACT ASSESSMENTS

EU processors and a number of EU Member States have requested the continuation of autonomous trade measures for fishery products in order to guarantee the supply of the EU fish processing industry.

Consultations with EU producers and processors were carried out from September 2011 to February 2012 in the framework of the Advisory Committee on Fisheries and Aquaculture.

Consultations with EU Member States took place from October 2011 to January 2012 in the Committee foreseen in Council Regulation (EC) No 104/2000.

Unilateral trade related measures applicable to fishery products were recently evaluated in the Impact Assessment of the Common Organisation of Markets (CMO). In addition to this, as suspensions of fishery products of Council Regulation (EU) No 1344/2011 are concerned, the future regime will be the transposition of an existing regime that it is revised every 6 months by the European Commission in consultation with EU Member States in the Economic Tariff Questions Group and in which fishery products represent an insignificant percentage.

In any event, the main impact of the current Regulation is the loss of revenue for the EU budget which in turn translates into duty preferences and competitive raw material for the EU processors of fishery products. On average imports under autonomous tariff quotas for fishery products represent an estimated 4,5% in value of the overall EU imports of fishery and aquaculture products, whereas imports under suspensions for fishery and aquaculture products account for roughly 5,2% in value of all EU imports of fishery products. Autonomous tariff quotas and suspensions of fishery and aquaculture products represent a maximum loss of revenue for the EU budget of roughly € 175 million per year.

However, autonomous tariff quotas and suspensions have also had a positive impact in the competitiveness of the EU fish processing industry. They have also helped to maintain and create jobs and production in some specific sectors and countries in the EU.

3.           LEGAL ELEMENTS OF THE PROPOSAL

Legal basis

Article 31 of the Treaty on the Functioning of the European Union.

Subsidiarity principle

Common Customs Tariff duties fall under the exclusive competence of the Union. The subsidiarity principle therefore does no apply for those provisions.

Proportionality principle

The proposal complies with the principle of proportionality for the following reason:

The Customs Union is a common policy and should therefore be implemented through a Regulation adopted by the Council.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 31 thereof,

Having regard to the proposal from the European Commission[5],

Whereas:

(1)       The scope of the Common Fisheries Policy extends to autonomous trade measures for fishery and aquaculture products in the Union. Since the Common Fisheries Policy is being reformed, the autonomous trade measures should be also revised to allow for more simplification, transparency and coherence in line with the objectives of the reform.

(2)       Union supplies of certain fishery products currently depend on imports from third countries. In the last 15 years the Union has become more dependent on imports to meet its consumption of fishery products: the Union self-sufficiency rate for fishery products has decreased from 57% to 38%. In order not to jeopardise the Union production of fishery products and to ensure the adequate supply to the Union processing industry, customs duties should be partially or totally suspended for a number of products withing tariff quotas of an appropiate volume. To guarantee a level playing field for the Union producers, the sensitivity of individual fishery products on the Union market should also be taken into consideration.

(3)       Council Regulation (EC) No 1062/2009[6] opened and provided for the management of autonomous Community tariff quotas for certain fishery products for the period 2010 to 2012. In order to guarantee appropriate supply conditions for the Union industry for the period 2013 to 2015, that Regulation should be repealed and replaced by a new regulation

(4)       Article 28 of and Annex VI to Council Regulation (EC) No 104/2000 of 17 December 1999 on the common organisation of the markets in fishery and aquaculture products[7] established suspensions of tariff duties for certain fishery products. Those suspensions will come to an end at the latest when the proposed new Regulation of the European Parliament and the Council on the common organisation of the markets in fishery and aquaculture products[8] becomes applicable. In order to ensure the continuity of the Union supplies of certain fishery products, a number of autonomous tariff quotas totally or partially replacing those suspensions should be established. As a consequence Article 28 of and Annex VI to Regulation (EC) N° 104/2000 should be deleted. The new autonomous tariff quotas should have a sufficient volume in order to guarantee the predictability and the continuity of the imports.

(5)       Council Regulation (EU) No 1344/2011 of 19 December 2011 suspending the autonomous Common Customs Tariff duties on certain agricultural, fishery and industrial products and repealing Regulation (EC) No 1255/96[9] contains a limited number of suspensions for fishery products. In order to improve the coherence and streamline the system and procedures of the Union autonomous preferences for fishery products, a number of autonomous tariff quotas replacing those suspensions should be established. As a consequence the entries concerning fishery products in the Annex to Regulation (EC) No 1344/2011 should be deleted. The new autonomous tariff quotas should have a sufficient volume in order to guarantee the predictability and the continuity of the imports.

(6)       Equal and uninterrupted access to the tariff quotas provided for in this Regulation should be ensured for all Union importers and the rates laid down for the quotas should be applied without interruption to all imports of the products concerned into all Member States until the tariff quotas have been used up.

(7)       To ensure the efficiency of a common management of the tariff quotas, Member States should be permitted to draw from the quota amount the necessary quantities corresponding to their actual imports. Since that method of management requires close cooperation between the Member States and the Commission, the latter should be able to monitor the rate at which the quotas are used up and should inform the Member States accordingly.

(8)       Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code[10] provides for a system of tariff quota management which follows the chrono­logical order of the dates of acceptance of the declarations of release for free circulation. The tariff quotas opened by this Regulation should be managed by the Commission and the Member States in accordance with that system.

HAS ADOPTED THIS REGULATION:

Article 1

1.           Import duties on the products listed in the Annex shall be suspended within the tariff quotas, at the rates, for the periods and up to the amounts indicated therein.

Article 2

The tariff quotas referred to in Article 1 shall be managed in accordance with Articles 308a, 308b and 308c (1) of Regulation (EEC) No 2454/93.

Article 3

The Commission and customs authorities of Member States shall cooperate closely to ensure the proper management and control of the application of this Regulation.

Article 4

1. Regulation (EC) No 1062/2009 is repealed.

2. In Regulation (EC) No 104/2000, Article 28 and Annex VI are deleted.

3. In the Annex to Regulation (EU) No 1344/2011, the entries concerning fishery products with TARIC codes 0302 89 90 30, 0302 90 00 95, 0303 90 90 91, 0305 20 00 11, 0305 20 00 30, 1604 11 00 20, 1604 32 00 10, 1605 10 00 11 and 1605 10 00 19 are deleted.

Article 5

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 January 2013 to 31 December 2015.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

(1) The quota is subject to the conditions laid down in the Articles 291 to 300 of Regulation (EEC) No 2454/93).

The quota is only available for products intended for human consumption.

(3) Products under CN codes 0306 11 90 (TARIC code 10) and 0306 21 90 (TARIC code 10) shall, notwithstanding footnote (2), qualify for the quota if they undergo one or both of the following operations: dividing the frozen product, subjecting the frozen product to heat treatment to enable the removal of internal waste material.

(4) Products under CN codes 1605 21 90 (TARIC codes 45 and 55) and 1605 29 00 (TARIC codes 50 and 60) shall, notwithstanding footnote (2), qualify for the quota if they undergo the operation of subjecting the shrimps and prawns to processing treatment by packaging gases as defined in Annex I to Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives[11].

4.           ANTI-FRAUD MEASURES

Checks on the end-use of some of the products covered by this Council Regulation will be carried out in accordance with Articles 291 to 300 of Commission Regulation (EEC) No 2454/93 laying down provisions for the implementation of the Community Customs Code.

5.           OTHER REMARKS

The main impact of the Regulation is the loss of revenue for the European Union. Taking the most recent complete statistics (2010) as a basis, the impact on the loss of revenue resulting from this Regulation may be estimated at € 170 million for the first year of the triennial period beginning in 2013. The estimation for 2014 and 2015 are based on the loss of revenues for 2013, to which a 3% of inflation has been added.

The loss of revenue for 2013, 2014 and 2015 are net amounts, i.e. gross amounts after deduction of 25% of collection costs.

The stated amount has been calculated on the basis of MFN duty rates and full utilisation of quotas. It marks, therefore, the maximum level of loss of revenue since the Community grants more favourable trade preferences to different groups of third countries (GSP, GSP+, FTA) and, on average, quotas utilisation, for those products under quotas, is roughly 75%.

Therefore the actual loss of revenue tends to result in a lower amount (estimated at € 47 million) since MFN duties do not apply across the board. It is estimated that imports of fishery products to the EU are levied an average duty of less than 3% ad valorem vis-à-vis the average MFN duty for fishery products of 10,9%.
