COMMISSION IMPLEMENTING REGULATION (EU) 2023/1488

of 6 July 2023

renewing the approval of the low-risk active substance quartz sand in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council, and amending Commission Implementing Regulation (EU) No 540/2011

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1107/2009, of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (1), and in particular Article 20(1) in conjunction with Article 22(1) thereof,

Whereas:

Commission Directive 2008/127/EC (2) included quartz sand as an active substance in Annex I to Council Directive 91/414/EEC (3).

(2)

According to Article 78(3) of Regulation (EC) No 1107/2009, active substances included in Annex I to Directive 91/414/EEC are deemed to have been approved under Regulation (EC) No 1107/2009 and are listed in Part A of the Annex to Commission Implementing Regulation (EU) No 540/2011 (4).

(3)

The approval of the active substance quartz sand, as set out in Part A of the Annex to Implementing Regulation (EU) No 540/2011, expires on 31 August 2023 (5).

An application for the renewal of the approval of the active substance quartz sand was submitted to Latvia, the rapporteur Member State, and Romania, the co-rapporteur Member State, in accordance with Article 1 of Commission Implementing Regulation (EU) No 844/2012 (6) and within the time period provided for in that Article.

(5)

The applicants also submitted the supplementary dossiers required by Article 6 of Implementing Regulation (EU) No 844/2012 to the rapporteur Member State, the co-rapporteur Member State, the Commission and the European Food Safety Authority (‘the Authority’). The application was found to be admissible by the rapporteur Member State.

The rapporteur Member State prepared a draft renewal assessment report in consultation with the co-rapporteur Member State and submitted it to the Authority and the Commission on 2 March 2021. In its draft renewal assessment report, the rapporteur Member State proposed to renew the approval of quartz sand.

(7)

The Authority made the supplementary summary dossier available to the public. The Authority also circulated the draft renewal assessment report to the applicants and to the Member States for comments and launched a public consultation on it. The Authority forwarded the comments received to the Commission.

On 16 August 2022, the Authority communicated to the Commission its conclusion (7) which indicated that quartz sand can be expected to meet the approval criteria provided for in Article 4 of Regulation (EC) No 1107/2009.

(9)

The Commission presented a renewal report regarding quartz sand and a draft of this Regulation to the Standing Committee on Plants, Animals, Food and Feed on on 8 December 2022 and on 25 May 2023 respectively.

The Commission invited the applicants to submit their comments on the conclusion of the Authority and, in accordance with Article 14(1), third subparagraph, of Implementing Regulation (EU) No 844/2012, on the renewal report. The applicants submitted their comments, which have been carefully examined and taken into consideration.

It has been established with respect to one or more representative uses of at least one plant protection product containing the active substance quartz sand that the approval criteria provided for in Article 4 of Regulation (EC) No 1107/2009 are satisfied.

(12)

The Commission further considers that quartz sand is a low-risk active substance pursuant to Article 22 of Regulation (EC) No 1107/2009. Quartz sand is not a substance of concern and fulfils the conditions set in point 5 of Annex II to Regulation (EC) No 1107/2009.

It is therefore appropriate to renew the approval of quartz sand as a low-risk active substance.

(14)

In accordance with Article 14(1) of Regulation (EC) No 1107/2009 in conjunction with Article 6 thereof and in the light of current scientific and technical knowledge and the outcome of the risk assessment, it is, however, necessary to set a minimum purity of quartz sand and a maximum amount of the impurity respirable crystalline silica (SiO2) with a diameter ≤ 10 μm as manufactured in order to underpin the safety of the active substance to be used in plant protection products.

(15)

Implementing Regulation (EU) No 540/2011 should therefore be amended accordingly.

(16)

This Regulation should apply from the day after the date of expiry of the approval of quartz sand.

(17)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Renewal of the approval of the active substance

The approval of the active substance quartz sand, as specified in Annex I, is renewed subject to the conditions laid down in that Annex.

Article 2

Amendments to Implementing Regulation (EU) No 540/2011

The Annex to Implementing Regulation (EU) No 540/2011 is amended in accordance with Annex II to this Regulation.

Article 3

Entry into force and application

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 September 2023.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,

Whereas:

Pursuant to Article 50(2)(a) of Regulation (EU) No 1151/2012, Türkiye’s application to register the name ‘Edremit Zeytinyağı’ was published in the Official Journal of the European Union (2).

(2)

As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the name ‘Edremit Zeytinyağı’ should therefore be entered in the register,

HAS ADOPTED THIS REGULATION:

Article 1

The name ‘Edremit Zeytinyağı’ (PDO) is hereby entered in the register.

The name specified in the first paragraph denotes a product in Class 1.5 – Oils and fats (butter, margarine, oil, etc.), as listed in Annex XI to Commission Implementing Regulation (EU) No 668/2014 (3).

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EU) 2023/1490

amending Regulation (EC) No 1223/2009 of the European Parliament and of the Council as regards the use in cosmetic products of certain substances classified as carcinogenic, mutagenic or toxic for reproduction

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products (1), and in particular Article 15(1) and Article 15(2), fourth subparagraph, thereof,

Whereas:

Regulation (EC) No 1272/2008 of the European Parliament and of the Council (2) provides for a harmonised classification of substances as carcinogenic, mutagenic or toxic for reproduction (CMR) based on a scientific assessment by the Risk Assessment Committee of the European Chemicals Agency. The substances are classified as CMR substances of category 1A, CMR substances of category 1B or CMR substances of category 2 depending on the level of evidence of their CMR properties.

(2)

Article 15 of Regulation (EC) No 1223/2009 provides that substances which have been classified as CMR substances of category 1A, category 1B or category 2 under Part 3 of Annex VI to Regulation (EC) No 1272/2008 (CMR substances) are to be prohibited from use in cosmetic products. A CMR substance may however be used in cosmetic products where the conditions laid down in Article 15(1), second sentence, of Regulation (EC) No 1223/2009 or in Article 15(2), second subparagraph of that Regulation are fulfilled.

(3)

In order to uniformly implement the prohibition of CMR substances within the internal market, to ensure legal certainty, in particular for economic operators and national competent authorities, and to ensure a high level of protection of human health, all CMR substances should be included in the list of prohibited substances in Annex II to Regulation (EC) No 1223/2009 and, where relevant, deleted from the lists of restricted or allowed substances in Annexes III to VI to that Regulation. Where the conditions laid down in Article 15(1), second sentence, of Regulation (EC) No 1223/2009 or in Article 15(2), second subparagraph of that Regulation are fulfilled, the lists of restricted or allowed substances in Annexes III to VI to that Regulation should be amended accordingly.

(4)

This Regulation covers substances classified as CMR substances by Commission Delegated Regulation (EU) 2022/692 (3) (‘the relevant substances’). Delegated Regulation (EU) 2022/692 will apply from 1 December 2023.

(5)

No request for use in cosmetic products by way of exception has been submitted for the relevant substances.

(6)

The relevant substances are currently neither restricted in Annex III to Regulation (EC) No 1223/2009, nor allowed in Annexes IV, V or VI to that Regulation.

(7)

The substance 2-ethylhexanoic acid (CAS No 149-57-5) is currently listed in entry 1024 of Annex II to Regulation (EC) No 1223/2009. However, the salts of that substance, which have been classified as CMR substances [of category 1B] by Delegated Regulation (EU) 2022/692, are not included in that entry. None of the other relevant substances are currently listed in Annex II to Regulation (EC) No 1223/2009. Therefore, those substances should be added to the list of substances prohibited in cosmetic products in Annex II to Regulation (EC) No 1223/2009 and the salts of the substance 2-ethylhexanoic acid should be added in entry 1024 of that Annex.

Regulation (EC) No 1223/2009 should therefore be amended accordingly.

(9)

The amendments to Regulation (EC) No 1223/2009 are based on the classifications of the relevant substances as CMR substances and should therefore apply from the same date as those classifications.

(10)

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Cosmetic Products,

HAS ADOPTED THIS REGULATION:

Article 1

Annexes II to Regulation (EC) No 1223/2009 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 December 2023.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2023/1491

of 19 July 2023

adding to the 2023 fishing quotas certain quantities withheld in the year 2022 pursuant to Article 4(2) of Council Regulation (EC) No 847/96

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 847/96 of 6 May 1996 introducing additional conditions for year-to-year management of TACs and quotas (1), and in particular Article 4(2) thereof,

Whereas:

According to Article 4(2) of Regulation (EC) No 847/96, for certain stocks subject to an analytical TAC, a Member State to which a relevant quota has been allocated may ask the Commission, before 31 October of the year of application of the quota, to withhold a maximum of 10 % of its quota to be transferred to the following year.

(2)

Council Regulations (EU) 2021/1888 (2), (EU) 2022/109 (3) and (EU) 2022/110 (4) fix fishing quotas for certain fish stocks for 2022 and specify which fish stocks may be subject to the measures provided for in Regulation (EC) No 847/96.

(3)

Council Regulations (EU) 2022/2090 (5), (EU) 2023/194 (6) and (EU) 2023/195 (7) fix fishing quotas for certain fish stocks for 2023.

Certain Member States requested, before 31 October 2022, that part of their quotas for 2022 for certain fish stocks be withheld and transferred to 2023. The fish stocks whose transfer is requested and their state of exploitation fulfil the conditions for such transfer laid down in Regulation (EC) No 847/96. Subject to the limits provided for in that Regulation, the quantities withheld should be added to the quotas for 2023.

In order to avoid excessive flexibility that would undermine the principle of rational and responsible exploitation of living marine biological resources, hinder the achievement of the objectives of the Common Fisheries Policy and deteriorate the biological status of the stocks, where a Member State has already used the year-to-year flexibility provided for under Article 15(9) of Regulation (EU) No 1380/2013 of the European Parliament and of the Council (8) in respect of a particular stock, no carry-over of unused fishing quotas should apply under Article 4 of Regulation (EC) No 847/96 and vice-versa.

The measures provided for in this Regulation are in accordance with the opinion of the Committee for Fisheries and Aquaculture,

HAS ADOPTED THIS REGULATION:

Article 1

The fishing quotas fixed for 2023 in Regulations (EU) 2022/2090, (EU) 2023/194 and (EU) 2023/195 are increased as set out in the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2023/1492

of 19 July 2023

amending Annex VII to Implementing Regulation (EU) 2019/2072 as regards the introduction into the Union territory of certain forms of wood originating in Canada and the United States

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against pests of plants, amending Regulations (EU) No 228/2013, (EU) No 652/2014 and (EU) No 1143/2014 of the European Parliament and of the Council and repealing Council Directives 69/464/EEC, 74/647/EEC, 93/85/EEC, 98/57/EC, 2000/29/EC, 2006/91/EC and 2007/33/EC (1), and in particular Article 41(2) thereof,

Whereas:

(1)

Certain forms of wood of Chionanthus virginicus L., Fraxinus L., Juglans ailantifolia Carr., Juglans mandshurica Maxim., Ulmus davidiana Planch. and Pterocarya rhoifolia Siebold & Zucc., originating from Belarus, Canada, China, the Democratic People’s Republic of Korea, Japan, Mongolia, the Republic of Korea, Russia, Taiwan, Ukraine and the United States, may only be introduced into the Union territory if they comply with the requirements set out in point 87 of Annex VII to Commission Implementing Regulation (EU) 2019/2072 (2).

(2)

Those requirements aim to protect the Union from Agrilus planipennis Fairmaire (‘the specified pest’).

(3)

By way of derogation from point 87(a) and (b) of Annex VII to Implementing Regulation (EU) 2019/2072, wood of Fraxinus L. (‘ash wood’) may be introduced into the Union territory from Canada in accordance with the special requirements set out in Commission Implementing Regulation (EU) 2020/918 (3). Those requirements are similar to the requirements established for the same wood from the same origin by Commission Implementing Decision (EU) 2016/412 (4). That Regulation expires on 30 June 2023.

By way of derogation from point 87(a) and (b) of Annex VII to Implementing Regulation (EU) 2019/2072, ash wood may be introduced into the Union territory from the United States in accordance with the special requirements set out in Commission Implementing Regulation (EU) 2020/1002 (5). Those requirements are similar to the requirements established by Commission Implementing Decision (EU) 2018/1203 (6) for the same wood with the same origin. That Regulation also expires on 30 June 2023.

Those special requirements have proven effective, during the application of Implementing Regulations (EU) 2020/918 and (EU) No 2020/1002, to protect the Union territory from the specified pest. Moreover, similar requirements have proven effective during the application of Implementing Decisions (EU) 2016/412 and 2018/1203.

On the basis of the evidence collected, it is concluded that the phytosanitary risk from the introduction of ash wood into the Union territory from Canada and the United States is reduced to an acceptable level and that appropriate mitigation measures are put in place in those third countries.

(7)

It appears that the special requirements set out in Implementing Regulations (EU) 2020/918 and (EU) No 2020/1002 are appropriate mitigation measures. It is therefore appropriate to include them in point 87 of Annex VII to Implementing Regulation 2019/2072.

(8)

Annex VII should provide that one of the following special requirements for the introduction into the Union territory of ash wood must be fulfilled: ash wood should either undergo ionizing irradiation or originate in a pest free area subject to certain conditions or undergo a process of debarking, sawing, heat treatment and drying, subject to specific conditions and in combination with specific requirements regarding the facilities where the wood is produced, handled or stored. In the last option, and in order to ensure effective controls and transparency, each bundle of the wood should visibly display both a number and a label with the words ‘HT-KD’ or ‘Heat Treated – Kiln Dried’.

Commission Implementing Regulation (EU) 2020/1164 (7) provides that, by way of derogation from point 87 to Annex VII to Implementing Regulation (EU) 2019/2072, certain forms of wood of Fraxinus L., Juglans ailantifolia Carr., Juglans mandshurica Maxim., Ulmus davidiana Planch. and Pterocarya rhoifolia Siebold and Zucc. (‘the specified wood’), originating in Canada and the United States, may be introduced into the Union territory under official statements referred to in options (a) and (b) of that point 87. That Regulation expires on 30 June 2023. It provides for the following two options as requirements for the introduction into the Union territory: the specified wood was to originate in a pest free area subject to certain conditions or to undergo ionizing irradiation under specific conditions.

Those special requirements have proven effective, during the application of Implementing Regulation (EU) 2020/1164, to protect the Union territory from the specified pest. Moreover, similar requirements have proven effective during the application of Implementing Decisions (EU) 2016/412 and 2018/1203.

(11)

Therefore, it is concluded that the phytosanitary risk from the introduction of ash wood into the Union territory from Canada and the United States is fully assessed and appropriate mitigation measures are put in place in those third countries.

(12)

It is therefore appropriate to include in Annex VII to Implementing Regulation 2019/2072 the special requirements that are provided for in Implementing Regulation (EU) 2020/1164 concerning the introduction into the Union territory of ash wood from Canada and the United States.

(13)

Canada and the United States should thus be removed from the fourth column of point 87 of Annex VII to Implementing Regulation (EU) 2019/2072, and a new point should be added to that Annex, providing for the same two options as those provided for by Implementing Regulation (EU) 2020/1164.

(14)

Annex VII to Implementing Regulation (EU) 2019/2072 should thus be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1

Amendment of Implementing Regulation (EU) 2019/2072

Annex VII to Implementing Regulation (EU) 2019/2072 is amended in accordance with the Annex to this Regulation.

Article 2

Entry into force

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Canada and United States

Official statement that:

(a)

the wood has undergone ionizing irradiation to achieve a minimum absorbed dose of 1 kGy throughout the wood;

or

(b)

the wood originates in an area recognised as being free from Agrilus planipennis Fairmaire, established by the national plant protection organisation in the country of origin, in accordance with the relevant International Standards for Phytosanitary Measures, and located at a minimum distance of 100 km to the closest known area, where the presence of that pest has been officially confirmed; the area is mentioned on the phytosanitary certificate, and the pest freedom status of that area has been communicated in advance in writing to the Commission by the national plant protection organisation in the third country,

or

(c)

 

(i)

the wood has undergone all of the following steps:

debarking, i.e. the wood is either completely debarked or only contain visually separate and clearly distinct pieces of bark. Each of the pieces is less than 3 cm in width or, if they are larger than 3 cm in width, has a surface of less than 50 cm2;

sawing;

heat treatment, i.e. the wood is heated through its profile to at least 71 °C for 1 200 minutes in a heat chamber approved by the national plant protection organization in the third country or an agency approved by that organization; and

drying, i.e. the wood is dried following industrial drying schedules of at least two-week duration, recognised by the national plant protection organization in the third country, and the final moisture content of the wood does not exceed 10 % expressed as a percentage of dry matter;

and

(ii)

the wood has been produced, handled or stored in a facility which fulfils all of the following requirements:

it is officially approved by the national plant protection organization in the third country or by an agency approved by that organisation, pursuant to its certification programme concerning Agrilus planipennis Fairmaire;

it is registered in a database published on the website of the national plant protection organization in the third country;

it is audited by the national plant protection organisation in the third country or an agency approved by that organisation, at least once per month and it has been concluded that it complies with the requirements of this Annex point. In case the audits have been performed by an agency other than the national plant protection organization in the third country, that organisation has carried out audits of this work at least every six months. Those audits have included the verification of the procedures and documentation of the agency, and audits at approved facilities;

it uses equipment for the treatment of wood which has been calibrated consistently with the equipment’s manual of operation;

it keeps record of its procedures for verification by the national plant protection organization in that country or an agency approved by that organisation, including the duration of treatment, temperatures during treatment and for each specific bundle to be exported, the compliance check and final moisture content.

and

(iii)

each bundle of the wood visibly displays both a number and a label with the words ‘HT-KD’ or ‘Heat Treated – Kiln Dried’. That label has been issued by, or under the supervision of, a designated officer of the approved facility after verifying that the processing requirements set out in point (i) and the requirements for facilities set out in point (ii) have been complied with.

and

The wood destined for the Union has been inspected by the national plant protection organisation in that country, or an agency officially approved by that authority, to ensure that the requirements laid down in points (i) and (iii) of this point are met. The bundle number(s) corresponding to each specific bundle being exported and the name of the approved facility(ies) in the country of origin shall be mentioned on the phytosanitary certificate referred to under the rubric ‘Additional declaration’.

87.2

establishing the position to be taken on behalf of the European Union within the Joint Committee established by the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community as regards the adoption of a decision adding two newly adopted Union acts to Annex 2 to the Windsor Framework

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 50(2) thereof,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

The Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (1) (the ‘Withdrawal Agreement’) was concluded by the Union by means of Council Decision (EU) 2020/135 (2) and entered into force on 1 February 2020.

(2)

Pursuant to Article 13(4) of the Windsor Framework (3), which forms an integral part of the Withdrawal Agreement, the Joint Committee established by Article 164(1) of the Withdrawal Agreement (the ‘Joint Committee’) is empowered to adopt decisions to amend the relevant Annexes to the Windsor Framework by adding newly adopted Union acts that fall within the scope of the Windsor Framework, but which neither amend nor replace Union acts listed in the Annexes to the Windsor Framework.

(3)

Regulation (EU) 2023/1182 of the European Parliament and of the Council (4), insofar as it does not amend Directive 2001/83/EC, and Regulation (EU) 2023/1231 of the European Parliament and of the Council (5) are newly adopted Union acts that relate to the internal market for goods and therefore fall within the scope of the Windsor Framework.

(4)

The Joint Committee, during its next meeting, should adopt a decision pursuant to Article 13(4) of the Windsor Framework adding those two newly adopted Union acts to Annex 2 to the Windsor Framework.

(5)

It is appropriate to establish the position to be taken on the Union’s behalf in the Joint Committee as regards the adoption of a decision adding two newly adopted Union acts to Annex 2 to the Windsor Framework,

THE JOINT COMMITTEE,

Having regard to the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (1) (the ‘Withdrawal Agreement’), and in particular Article 13(4) of the Windsor Framework (2),

Whereas:

(1)

Article 13(4) of the Windsor Framework empowers the Joint Committee established under Article 164(1) of the Withdrawal Agreement (the ‘Joint Committee’) to adopt decisions adding newly adopted Union acts falling within the scope of the Windsor Framework to the relevant Annexes to the Windsor Framework. Pursuant to Article 166(2) of the Withdrawal Agreement, the decisions adopted by the Joint Committee are binding on the Union and the United Kingdom. The Union and the United Kingdom are to implement such decisions, which have the same legal effect as the Withdrawal Agreement.

(2)

Two newly adopted Union acts should be added to Annex 2 to the Windsor Framework,

HAS ADOPTED THIS DECISION:

Article 1

1.   Regulation (EU) 2023/1182 of the European Parliament and of the Council of 14 June 2023 on specific rules relating to medicinal products for human use intended to be placed on the market in Northern Ireland and amending Directive 2001/83/EC (3), insofar as it does not amend Directive 2001/83/EC, shall be added to Annex 2 to the Windsor Framework under point 20 ‘Medicinal products’.

2.   Regulation (EU) 2023/1231 of the European Parliament and of the Council of 14 June 2023 on specific rules relating to the entry into Northern Ireland from other parts of the United Kingdom of certain consignments of retail goods, plants for planting, seed potatoes, machinery and certain vehicles operated for agricultural or forestry purposes, as well as non-commercial movements of certain pet animals into Northern Ireland (4) shall be added to Annex 2 to the Windsor Framework under point 44 ‘Sanitary and phytosanitary – Other’.

Article 2

This Decision shall enter into force on the day following that of its adoption.

on the position to be taken on behalf of the European Union within the Joint Committee established by the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community as regards the adoption of a decision to amend Part I of Annex I to that Agreement

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 50(2) thereof,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

The Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (1) (the ‘Withdrawal Agreement’) was concluded by the Union by means of Council Decision (EU) 2020/135 (2) and entered into force on 1 February 2020.

(2)

Pursuant to Article 36(4) of the Withdrawal Agreement, the Joint Committee shall adopt decisions to amend Part I of Annex I to the Withdrawal Agreement to reflect any new Decision or Recommendation approved by the Administrative Commission for the Coordination of Social Security Systems.

(3)

The Joint Committee, during its next meeting, is to adopt a decision pursuant to Article 36(4) of the Withdrawal Agreement to amend Part I of Annex I thereto to add two new Decisions approved by the Administrative Commission for the Coordination of Social Security Systems to the list set out therein and to delete from that list three Decisions that have been replaced by the two new Decisions.

It is appropriate to establish the position to be taken on the Union’s behalf in the Joint Committee as regards the adoption of a decision to amend Part I of Annex I to the Withdrawal Agreement, which decision will be binding on the Union,

HAS ADOPTED THIS DECISION:

Article 1

The position to be taken on behalf of the European Union within the Joint Committee established by Article 164(1) of the Withdrawal Agreement as regards the adoption of a decision to amend Part I of Annex I to the Withdrawal Agreement is set out in the draft decision of the Joint Committee attached to this Decision.

Article 2

This Decision shall enter into force on the date of its adoption.

THE JOINT COMMITTEE,

Having regard to the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (1) (the ‘Withdrawal Agreement’), and in particular Article 36(4) thereof,

Whereas:

(1)

Article 36(4) of the Withdrawal Agreement empowers the Joint Committee established under Article 164(1) thereof (the ‘Joint Committee’) to adopt decisions amending Part I of Annex I to that Agreement, to reflect any new Decision or Recommendation approved by the Administrative Commission for the Coordination of Social Security Systems. Pursuant to Article 166(2) of the Withdrawal Agreement, the decisions adopted by the Joint Committee are binding on the Union and the United Kingdom. The Union and the United Kingdom must implement such decisions, which shall have the same legal effect as the Withdrawal Agreement.

(2)

In the interest of legal certainty, Part I of Annex I to the Withdrawal Agreement should be amended by adding two decisions of the Administrative Commission for the Coordination of Social Security Systems and by deleting three decisions which were replaced by the two new decisions,

HAS ADOPTED THIS DECISION:

Article 1

The Withdrawal Agreement shall be amended as follows:

(1)

In Part I of Annex I to the Withdrawal Agreement, Decision No H12 of 19 October 2021 concerning the date to be taken into consideration for determining the rates of conversion referred to in Article 90 of Regulation (EC) No 987/2009 of the European Parliament and of the Council (2) shall be added under ‘Horizontal issues (H series)’;

(2)

In Part I of Annex I to the Withdrawal Agreement, Decision No H13 of 30 March 2022 concerning the composition and working methods of the Audit Board of the Administrative Commission for the Coordination of Social Security Systems (3)shall be added under ‘Horizontal issues (H series)’;

(3)

In Part I of Annex I to the Withdrawal Agreement, the following acts shall be deleted:

(a)

Decision No H3 of 15 October 2009 concerning the date to be taken into consideration for determining the rates of conversion referred to in Article 90 of Regulation (EC) No 987/2009 of the European Parliament and of the Council (4), as amended by Decision No H7 of 25 June 2015 on the revision of the Decision No H3 concerning the date to be taken into consideration for determining the rates of conversion referred to in Article 90 of Regulation (EC) No 987/2009 of the European Parliament and of the Council (5), which is replaced by Decision No H12 of 19 October 2021 concerning the date to be taken into consideration for determining the rates of conversion referred to in Article 90 of Regulation (EC) No 987/2009 of the European Parliament and of the Council;

(b)

Decision No H4 of 22 December 2009 concerning the composition and working methods of the Audit Board of the Administrative Commission for the Coordination of Social Security Systems (6), which is replaced by Decision No H13 of 30 March 2022 concerning the composition and working methods of the Audit Board of the Administrative Commission for the Coordination of Social Security Systems;

(c)

Decision No H7 of 25 June 2015 on the revision of the Decision No H3 concerning the date to be taken into consideration for determining the rates of conversion referred to in Article 90 of Regulation (EC) No 987/2009 of the European Parliament and of the Councilwhich is replaced by Decision No H12 of 19 October 2021 concerning the date to be taken into consideration for determining the rates of conversion referred to in Article 90 of Regulation (EC) No 987/2009 of the European Parliament and of the Council.

Article 2

This Decision shall enter into force on the day following that of its adoption.
