Notice concerning the date of entry into force of the amendment to Annex 14-B of the Agreement between the European Union and Japan for an Economic Partnership
By means of its Decision No 1/2022, the Joint Committee established under the Agreement between the European Union and Japan for an Economic Partnership (1), signed in Tokyo on 17 July 2018, decided to amend Annex 14-B of the Agreement. The amendment entered into force on 1 February 2022.

amending Regulation (EC) No 1223/2009 of the European Parliament and of the Council as regards the use of Methyl-N-methylanthranilate in cosmetic products

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products (1), and in particular Article 31(1) thereof,
Whereas:

The substance Methyl-N-methylanthranilate (M-N-MA) (CAS No 85-91-6) is a fragrance ingredient used in various cosmetics, including fine fragrances, shampoos, soaps and other toiletries. M-N-MA is currently not subject to any prohibition or restriction pursuant to Regulation (EC) No 1223/2009. |

The Scientific Committee on Consumer Safety (SCCS) concluded in an opinion adopted at its plenary meeting of 13-14 December 2011 (2) that there were no safety concerns for use of M-N-MA in a concentration of up to 0,2 % in rinse-off products. It further noted that M-N-MA is phototoxic, which was the toxicological endpoint of concern in that opinion. Whilst up to 0,1 % M-N-MA may be safe for use in many leave-on cosmetic products, the SCCS found that a risk cannot be excluded for the use of that substance in sunscreen or sun care products or products (including fragrances) intended for use on areas exposed to light. Moreover, the SCCS concluded that since M-N-MA is prone to nitrosation, it should not be used in combination with nitrosating agents and the nitrosamine content should be below 50 μg/kg. |

At the plenary meeting of 27 March 2012, the SCCS adopted an opinion on nitrosamines and secondary amines (3). In that opinion, the SCCS concluded that the purity specification of 50 μg nitrosamine/ kg should apply to raw materials and to all nitrosamines potentially formed, and not to finished products. It further concluded that the secondary amines should not be in contact with adventitious nitrosating agents such as nitrite treated raw material containers. That opinion applies also to M-N-MA, which is a secondary amine. |

Subsequently, SCCS has concluded, in a scientific advice of 16 October 2020 on the SCCS opinion on M-N-MA (4), that M-N-MA should not be used in sunscreen products and products marketed for exposure to natural or artificial UV light. For other cosmetic products, SCCS considered the use of M-N-MA safe in a concentration of up to 0,1 % for leave-on products and 0,2 % for rinse-off products. |

In light of the SCCS opinions and scientific advice, there is a potential risk to human health arising from the use of M-N-MA in sunscreen products and products marketed for exposure to natural or artificial UV light and in other cosmetic products where the concentration of the substance is more than 0,1 % for leave-on products and 0,2 % for rinse-off products. Therefore, such use of M-N-MA should be prohibited. |

In light of the SCCS opinions and scientific advice, there is also a potential risk to human health arising from the use of M-N-MA with nitrosating agents. Therefore, such use of M-N-MA should be prohibited, a maximum nitrosamine content of 50 μg/kg should be set and a requirement to keep cosmetic products containing M-N-MA in nitrite-free containers should be introduced. |

Regulation (EC) No 1223/2009 should therefore be amended accordingly. |

The industry should be allowed a reasonable period of time to adapt to the new requirements by making the adjustments to product formulations and containers that are necessary to ensure that only cosmetic products complying with the new requirements are placed on the market. The industry should also be allowed a reasonable period of time to withdraw cosmetic products which do not comply with the new requirements from the market. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Cosmetic Products, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex III to Regulation (EC) No 1223/2009 is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2022/136
of 31 January 2022
amending Annex I to Implementing Regulation (EU) 2021/605 laying down special control measures for African swine fever

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,
Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
(2) |
Commission Implementing Regulation (EU) 2021/605 (2) was adopted within the framework of Regulation (EU) 2016/429, and it lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States listed in Annex I thereto (the Member States concerned), in restricted zones I, II and III listed in that Annex. |

The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2021/605 was last amended by Implementing Regulation (EU) 2022/97 (3) following changes in the epidemiological situation as regards that disease in Bulgaria, Germany and Slovakia. |

Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health and justifications for zoning provided by the competent authorities of the Member States concerned. |

There have now been new outbreaks of African swine fever in wild porcine animals in Poland. |
(6) |
In January 2022, several outbreaks of African swine fever in wild porcine animals were observed in the Opolskie and Dolnośląskie regions in Poland in areas currently listed as restricted zones I in Annex I to Implementing Regulation (EU) 2021/605. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, those areas of Poland currently listed as restricted zones I in that Annex, affected by those recent outbreaks of African swine fever, should now be listed as restricted zones II in that Annex instead of as restricted zones I thereof and the current boundaries of restricted zones I also need to be redefined to take account of those recent outbreaks. |

In addition, in January 2022, several outbreaks of African swine fever in wild porcine animals were observed in the Podkarpackie region in Poland in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to an area currently listed as restricted zone I thereof. Those new outbreaks of African swine fever in wild porcine animals constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Poland currently listed as restricted zone I in that Annex, that is in close proximity to the area listed in restricted zone II affected by those recent outbreaks of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof. |

Following those recent outbreaks of African swine fever in wild porcine animals in Poland and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in this Member State has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2021/605. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new restricted zones of a sufficient size should be demarcated for Poland and duly listed as restricted zones I and II in Annex I to Implementing Regulation (EU) 2021/605. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the situation in the surrounding areas. |

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2021/605 by this Implementing Regulation take effect as soon as possible. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex I to Implementing Regulation (EU) 2021/605 is replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING DECISION (EU) 2022/137

concerning the extension of the action taken by the Health and Safety Executive of the United Kingdom permitting the making available on the market and use of the biocidal product Mydis in accordance with Article 55(1) of Regulation (EU) No 528/2012 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 55(1), third subparagraph, thereof, in conjunction with Article 5(4) of the Protocol on Ireland/Northern Ireland to the Agreement on the Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community,
Whereas:

On 11 March 2021, the Health and Safety Executive of the United Kingdom acting on behalf of the Health and Safety Executive for Northern Ireland (‘the UK competent authority’) adopted a decision in accordance with Article 55(1), first subparagraph, of Regulation (EU) No 528/2012, to permit the making available on the market and use in Northern Ireland of the biocidal product for hand disinfection Mydis, until 21 August 2021 (‘the action’). The UK competent authority informed the Commission and the competent authorities of the Member States of the action and the justification for it, in accordance with Article 55(1), second subparagraph, of that Regulation. |

According to the information provided by the UK competent authority, the action was necessary in order to protect public health. On 11 March 2020, the World Health Organization (WHO) declared that the outbreak of the coronavirus disease (COVID-19) could henceforth be characterised as a pandemic. The Government of the United Kingdom declared the risk to the United Kingdom as ‘high’ and, on 23 March 2020, restrictive measures came into effect. The use of alcohol-based hand disinfectants is recommended by the WHO as a preventive measure against the spread of COVID-19, as an alternative to washing hands with soap and water. |

Mydis contains active chlorine released from hypochlorous acid as an active substance. Active chlorine released from hypochlorous acid is approved for use in biocidal products of product-type 1, namely ‘human hygiene’, as defined in Annex V to Regulation (EU) No 528/2012. |

Since the outbreak of COVID-19, hand disinfectants have been in extremely high demand in the United Kingdom, which has led to unprecedented supply shortages of such products. Prior to the action, there were very few hand disinfectants authorised in the United Kingdom in accordance with Regulation (EU) No 528/2012. COVID-19 represents a serious threat to public health in the United Kingdom and additional hand disinfectants are crucial in preventing its spread. |

On 17 August 2021, the Commission received a reasoned request from the UK competent authority to allow the extension of the action in the United Kingdom in respect of Northern Ireland, in accordance with Article 55(1), third subparagraph, of Regulation (EU) No 528/2012. The reasoned request was made on the basis of concerns that public health might be endangered by COVID-19 beyond 21 August 2021 and taking into account that allowing additional hand disinfectants on the market is crucial in order to contain the dangers posed by COVID-19. |

According to the UK competent authority, the demand for hand sanitisers remains high, therefore an extension of the action in the United Kingdom in respect of Northern Ireland is needed. |
(7) |
Companies that have received derogations for hand disinfectants in accordance with Article 55(1), first subparagraph, of Regulation (EU) No 528/2012 after the WHO declaration on the pandemic have been encouraged to seek regular product authorisation as soon as possible. However, no new applications for regular product authorisation have been received by the UK competent authority to date. |

As COVID-19 continues to pose a danger to public health and such danger cannot be adequately contained in the United Kingdom in respect of Northern Ireland in the absence of additional hand disinfectants being allowed on the market, it is appropriate to allow the UK competent authority to extend the action in the United Kingdom in respect of Northern Ireland. |

Considering that the action expired on 21 August 2021, this Decision should have retroactive effect. |
(10) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products, |
HAS ADOPTED THIS DECISION:
Article 1
The Health and Safety Executive of the United Kingdom, acting on behalf of the Health and Safety Executive for Northern Ireland, may extend until 23 February 2023 the action to permit the making available on the market and use of the biocidal product Mydis, in the United Kingdom in respect of Northern Ireland.
Article 2
This Decision is addressed to the Health and Safety Executive of the United Kingdom, acting on behalf of the Health and Safety Executive for Northern Ireland.
It shall apply from 22 August 2021.

DECISION No 1/2022 OF THE JOINT COMMITTEE UNDER THE AGREEMENT BETWEEN THE EUROPEAN UNION AND JAPAN FOR AN ECONOMIC PARTNERSHIP
of 21 January 2022
on the amendments to Annex 14-B on geographical indications [2022/138]
THE JOINT COMMITTEE,
Having regard to the Agreement between the European Union and Japan for an Economic Partnership (hereinafter referred to as the ‘Agreement’), and in particular Articles 14.30 and 22.2 thereof,
Whereas:

The Agreement entered into force on 1 February 2019. |
(2) |
Within the framework of the Committee on Intellectual Property, the European Union and Japan (hereinafter referred to as ‘the Parties’) confirmed that every year, starting from 2020 and until 2022, the Joint Committee will consider up to 28 names from the European Union and from Japan respectively to be protected as geographical indications (hereinafter referred to as ‘GIs’) and added in Annex 14-B of the Agreement, provided that those names are protected as GIs domestically (1). As from 2023, the Parties will work to continuously add to Annex 14-B additional GIs in view of each side’s interests under close coordination between the Parties. On 1 February 2021, in accordance with Article 14.30 of the Agreement, 28 GIs of the European Union and 28 GIs of Japan have been added in Annex 14-B of the Agreement. (2) |

Following the request of the Parties and pursuant to paragraph 1 of Article 14.30, the European Union has completed the opposition procedure and the examination of 28 additional GIs of Japan and Japan has completed the opposition procedure and the examination of 28 additional GIs of the European Union. |
(4) |
On 13 December 2021, in accordance with paragraph 3 of Article 14.53 of the Agreement, the Committee on Intellectual Property recommended to the Joint Committee to amend Annex 14-B to the Agreement accordingly. |
(5) |
The Parties completed their internal procedures necessary for adoption of the Decision by the Joint Committee under the Agreement, and endeavour to exchange the diplomatic notes confirming the amendments to the Agreement not more than ten working days after the Decision is adopted. |
(6) |
Consequently, Annex 14-B to the Agreement should be amended, in accordance with paragraph 3 and subparagraph 4(g) of Article 23.2 of the Agreement. |
(7) |
Following the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union as from 1 January 2021, according to paragraph 3 of Article 14.30 of the Agreement, the lists of GIs of the United Kingdom should be removed from the lists of GIs of the European Union in Annex 14-B of the Agreement. |
HAS ADOPTED THIS DECISION:
Article 1
a) |
In Section A of Part 1 of Annex 14-B to the Agreement, the list of GIs of the United Kingdom shall be removed and the GIs listed in Annex 1 to this Decision shall be added under the corresponding list of GIs of the respective Member State of the European Union. |
b) |
In Section B of Part 1 of Annex 14-B to the Agreement, the GIs listed in Annex 2 to this Decision shall be added to the list of GIs of Japan. |
c) |
In Section A of Part 2 of Annex 14-B to the Agreement, the list of GIs of the United Kingdom shall be removed and the GIs listed in Annex 3 to this Decision shall be added under the corresponding list of GIs of the respective Member State of the European Union. |
d) |
In Section B of Part 2 of Annex 14-B to the Agreement, the GIs listed in Annex 4 to this Decision shall be added to the list of GIs of Japan. |
Article 2
a) |
In the fourth year of implementation of the Agreement, the Joint Committee will decide on the addition to Annex 14-B of the Agreement of a number of up to 27 names from the European Union and from Japan respectively to be protected as GIs under the Agreement, provided that those names are GIs protected in the territory of the Party in accordance with its laws and regulations. |
b) |
As from the fifth year of implementation of the Agreement, the Parties will work to continuously include additional GIs in view of the interests of each Party. |
Article 3
This Decision is drawn up in duplicate. Article 1 and Annexes to this Decision are drawn up in duplicate in the authentic languages of the Agreement provided for in paragraph 1 of Article 23.8 of the Agreement, all texts being equally authentic.
Article 4
This Decision shall be implemented by the Parties as referred to in paragraph 1 of Article 22.2 of the Agreement. The amendments to the Agreement adopted through this Decision shall be confirmed by and enter into force upon the exchange of diplomatic notes in accordance with paragraph 3 of Article 23.2 of the Agreement.
