DECISION OF THE EEA JOINT COMMITTEE No 235/2021
of 24 September 2021
amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/518]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,
Whereas:

(1) |
Commission Implementing Regulation (EU) 2021/547 of 29 March 2021 amending Implementing Regulation (EU) 2019/1715 as regards procedures for the establishment and use of ADIS and EUROPHYT, the issuance of electronic animal health certificates, official certificates, animal health/official certificates and commercial documents, the use of electronic signatures, and the functioning of TRACES, and repealing Decision 97/152/EC (1) is to be incorporated into the EEA Agreement. |

(2) |
Implementing Regulation (EU) 2021/547 repeals Commission Decision 97/152/EC (2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement. |

(3) |
This Decision concerns legislation containing provisions regarding live animals other than fish and aquaculture animals. Provisions concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore to apply to Iceland for the areas referred to in paragraph 2 of the Introductory Part. |

This Decision concerns legislation regarding veterinary matters, feedingstuffs and foodstuffs. Legislation regarding veterinary matters, feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein. |

Annexes I and II to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Annex I to the EEA Agreement shall be amended as follows:

The following is added in point 11bd (Commission Implementing Regulation (EU) 2019/1715) in Part 1.1 of Chapter I: ‘, as amended by:
This act applies to Iceland for the areas referred to in paragraph 2 of the Introductory Part.’ |

2. |
The following is added in point 31qd (Commission Implementing Regulation (EU) 2019/1715) of Chapter II: ‘, as amended by:

3. |
The text of point 57 (Commission Decision 97/152/EC) in Part 1.2 of Chapter I is deleted. |
Article 2
The following is added in point 164d (Commission Implementing Regulation (EU) 2019/1715) of Chapter XII of Annex II to the EEA Agreement:

Article 3
The text of Implementing Regulation (EU) 2021/547 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 25 September 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 5
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
